Has anyone purchased a ipod touch 8gb 3rd Gen and was told its a 2 Gen?

I brought a ipod touch 8GB 3rd Gen at best buy, after having trouble with the infamous iOS4 update I contacted Apple about it. of course they gave me all the low down about what it could be so on and so on, but when I gave them the serial number they tell me it's a ipod touch 8GB 2 Gen! I told them where I purchased it and they said they could only tell me what they get from the manufacture and to go back to best buy because they might have sold me something else, so I did when I explained it to one of the workers they ured me it was indeed a 3rd Gen they would absolutely not sell people something that was something else. at first I thought they might have just been covering their backsides but they took it and checked everywhere on the internet, even tried pulling it up on Apple's website but it was saying that it was a 2 and a 3rd Gen or saying it wasn't a valid serial number, which it very much was best buy gets their apple products directly through Apple and they get no profit at all from the products. the issues just seemed impossible to solve so they gave me a replacement instead, which shocked me best buy is awesome! now I believe Apple was the ones that had their wires crossed. and would you believe that they have the nerve to say my new one is a 2 Gen too?? Apple is ridiculous! has this happened to anyone else? if so how did you get it resolved?
